Joana Quaye, Ex-wife of businessman Richard Nii Armah Quaye (RNQA) has filed an appeal to overturn ruling by an Accra High Court that dissolved their marriage and distributed some properties acquired when they were married.
The appeal application which was filed on her behalf by the former Attorney-General and Minister of Justice, Godfred Yeboah Dame, seeks declarative reliefs from the Court of Appeal setting aside the final orders of the High Court Presided by Justice Dorgu who sat as an Additional High Court Judge of the Family Court to deliver the impugned decision.
Per a ground of Appeal raised in the Notice of Appeal filed by Mr. Dame on behalf of Mad. Joana Quaye, a copy of which can be read/downloaded below, “The learned trial judge committed a fundamental error of law by failing to recognise that all the immovable and movable properties claimed by respondent, including shares in companies, were acquired during the subsistence of the marriage and thus constitute marital property to be distributed equitably between the parties.”
In particularizing the error of law raised as a ground for the Court of Appeal to set aside the decision of the High Court, Lawyers for Ms. Quaye averred as follows; “The learned trial judge committed a fundamental error of law by failing to recognise that all the immovable and movable properties claimed by respondent, including shares in companies, were acquired during the subsistence of the marriage and thus constitute marital property to be distributed equitably between the parties.”
